Agreement to Terms

By accessing and using OccasionPack, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this service.

1. Acceptance of Terms

These Terms of Service (“Terms”) govern your use of the OccasionPack website at occasionpack.com and its services. By creating an account, making a purchase, or using our service in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms.

Important Note

If you do not agree to these Terms, please do not use our service. Your continued use of OccasionPack constitutes acceptance of any updates to these Terms.

2. Description of Service

OccasionPack is a digital service that uses artificial intelligence to create personalised event invite videos, images and other digital occasion content from your photos.

What We Provide

• AI-powered invite video generation
• Multiple video styles and templates
• High-resolution video downloads
• Personalised event invite videos

Products

The products included in each package are set out in section 5 (Packages).

3. Personalised and AI-Generated Content

OccasionPack products are created using generative artificial intelligence.

AI-generated content is probabilistic. Results may not reproduce a person, object or requested detail perfectly and different generations may produce different results.

Minor differences between reference photographs and generated characters are therefore not automatically considered defects.

We aim to provide products that reasonably correspond to the selected product, theme and information supplied with the order.

This does not affect your statutory rights where delivered content does not conform to what was agreed.

4. User Accounts

Account Registration

To use our service, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials.

Account Responsibilities

• You must be at least 18 years old to create an account
• OccasionPack is not a service for children to use independently
• Provide accurate and truthful information
• Keep your login credentials secure
• Notify us immediately of any unauthorized access
• You are responsible for all activities under your account

5. Payment Terms

Payments and Merchant of Record

All purchases are made through Stripe Technologies Europe Ltd, which acts as the merchant of record. This means Stripe is the seller of record for your payment: it processes your payment securely, issues your receipt, and calculates, collects and pays the VAT or sales tax that applies in your country of residence. Any applicable tax is shown at checkout before you pay.

OccasionPack, operated by Triangel Systems OÜ, provides the service and the content you purchase. These Terms govern your use of the service and that content. Payment is required before generation starts.

Packages

OccasionPack offers two packages. Both are one-off payments; there is no subscription and nothing renews automatically.

• MOMENT: a personalised picture and invitation, Facebook event cover image, and a 10-second video
• WONDER: everything in MOMENT, plus a 15-second video, a 10-page colouring book (PDF) on eligible kids’ packs, and ability to capture still-images from the video.

Package contents are subject to change from time to time. The contents of each package are shown before purchase.

Refund Policy

We offer a 7-day money back guarantee for quality or delivery issues with your purchase. Eligibility, the request process and refund payments are set out in our Refund Policy, which forms part of these Terms.

Right of Withdrawal (EU and UK)

If you are a consumer in the EU or the UK, you have 14 days from purchase to withdraw from a contract for digital content or services. When you ask us to start generating your content straight away, you expressly consent to immediate performance and acknowledge that you lose your right of withdrawal once generation has started. To exercise this right, contact support@occasionpack.com. Our Refund Policy explains how withdrawal refunds are paid, and our 7-day money back guarantee applies in addition to this right.

Generation Failures

AI generation can occasionally fail or produce unusable results. Where our quality controls determine that a generation has failed, OccasionPack may automatically retry the generation.

If we cannot provide the purchased product because of a technical failure on our side, we will regenerate it or refund it under our Refund Policy. Depending on the product purchased, additional regeneration or revision options may be provided.

We do not guarantee that every creative request can be generated exactly as imagined.

6. Intellectual Property

Your Content

You retain your rights in photographs and other original content you provide to OccasionPack. By uploading content, you give OccasionPack the limited permission necessary to process that content for providing and operating the services you request, including transmitting it to service providers involved in producing your order. Our AI generation provider may also use content it receives to train and improve its own AI models, as described in our Privacy Policy. Content already used for training cannot be removed from a trained model.

You confirm that you have the right to use any content you upload and that it does not infringe the rights of others.

Photos of Children and Other People

For images featuring children, you confirm that you are the child’s parent or legal guardian, or have the permission of the child’s parent or legal guardian, to use the image for the requested purpose.

For images featuring other people, you confirm that you have any permission or lawful authority necessary for the intended use.

Personal Use Licence

Subject to applicable law and any third-party rights, you may use and share the final personalised products delivered to you for personal purposes, including sending your invite to your guests.

You remain responsible for ensuring that your use of generated content does not violate the rights of another person or applicable law.

OccasionPack is currently offered for personal, non-commercial use only.

If your purchase is refunded, this licence ends for the refunded content, as set out in our Refund Policy.

Themes and Characters

OccasionPack may provide original themes such as dinosaur adventures, space exploration, aviation adventures, fantasy worlds and similar creative concepts.

Requests for protected characters, brands or visual identities you do not have the right to use are not permitted under our Content Policy. We may refuse such requests, for example a specific copyrighted movie character or franchise, or transform them into an original, non-infringing concept.

Our Rights

OccasionPack retains rights in its software, brand, templates, workflows and other proprietary elements of the service.

7. User Conduct

You agree to use OccasionPack only for lawful purposes and in accordance with these Terms. You are prohibited from using the service in any way that could damage, disable, or impair our systems.

Prohibited Activities

• Attempting to reverse engineer our AI technology
• Using automated systems to access our service
• Uploading malware or other malicious code
• Violating any applicable laws or regulations
• Interfering with other users’ use of the service
• Attempting to gain unauthorized access to our systems

Prohibited Content

You must follow our Content Policy, which forms part of these Terms and sets out what you may and may not upload, enter or create with OccasionPack.

We may refuse generation, cancel an order or restrict access where we reasonably believe these rules have been violated.

8. Misuse Prevention

OccasionPack is built for celebrating real occasions. You must not use OccasionPack, or any content it produces, to create or distribute malicious, misleading or harmful material. Our Content Policy sets out the detailed rules, how we check content, how we enforce the rules and how to report content.

Consequences of a breach

If you breach these Terms or the Content Policy, we may refuse or stop a generation, remove content, cancel orders, suspend or permanently close your account and refuse future service. Where we cancel an order or close an account because of a serious breach, prepaid amounts may not be refunded, except where required by applicable consumer law.

We may preserve related account information and content where the law requires it or where it is needed to investigate misuse.

You are responsible, to the extent permitted by applicable law, for any loss or claim that results from your breach of these rules.

9. Service Availability

We strive to provide reliable service but cannot guarantee 100% uptime. Our service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

Third-Party Services

OccasionPack relies on third-party infrastructure, payment and AI-generation services. Temporary outages or changes affecting these services may affect generation times or availability. We select and manage providers with the aim of maintaining appropriate security, privacy and reliability.

Changes to the Service

We may add, modify or discontinue products, themes, features or generation providers. Where a change materially affects an existing paid order, applicable consumer rights will continue to apply.

10. Privacy and Retention

Our processing of personal information is described in our Privacy Policy, including retention and deletion periods, the use of content by our AI generation provider, and the separate permission we need before using your photographs or creations in marketing.

11. Limitation of Liability

To the maximum extent permitted by applicable law, OccasionPack provides the service “as is” without warranties of any kind, and shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our service.

Liability Limitations

Our total liability to you for any claims arising from your use of OccasionPack shall not exceed the amount you paid for the specific service that gave rise to the claim.

Mandatory Consumer Rights

Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law, including mandatory consumer-protection rights.

In particular, nothing in these Terms limits our liability for death or personal injury caused by negligence, for fraud, or for intentional or grossly negligent breach. If you are a consumer in the UK, nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015. If you are a consumer in Australia, our services come with guarantees that cannot be excluded under the Australian Consumer Law, and these Terms do not exclude, restrict or modify them.

12. Termination

Account Termination

You may terminate your account at any time by contacting us. We reserve the right to terminate or suspend accounts that violate these Terms or engage in prohibited activities.

Grounds for Termination

• Violation of these Terms of Service
• Fraudulent or illegal activity
• Abuse of our service or systems
• Failure to pay for services
• At our sole discretion for any reason

Effect of Termination

Upon termination, your access to the service will cease immediately. You may retain any invite videos you have already downloaded. No refunds will be provided for unused services, except where required by applicable consumer law or where we terminate without cause, in which case we will refund any prepaid amount for services not yet provided.

13. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Estonia, without depriving consumers of mandatory protections available to them under the laws applicable in their country of residence.

Please contact us first at info@occasionpack.com so we can try to resolve any dispute informally. Disputes will be settled by the courts of Estonia. If you are a consumer, you may also bring proceedings in the courts of your country of residence where the law allows.
